2. Conclusion of Contract

The presentation of the products in the online shop merely represents a tentative offer to order goods from us. By placing a purchase order, you make a binding offer for the conclusion of a purchase contract. The auto-generated order confirmation e-mail does not yet constitute an acceptance of the offer, but merely documents that we have received the purchase order. We may decide to accept or reject a purchase order at our own discretion.

Our acceptance of the offer takes place within three working days by sending a separate order confirmation by e-mail or by delivering the goods. A contract for goods not available for delivery will not come into existence, and any money already paid will be refunded within 30 days.

We sell our goods exclusively to end consumers who are of age, and only in retail quantities.

3. Prices and Taxes

3.1 Prices

The prices quoted at the time shall apply. All prices include statutory VAT.

3.2 Taxes

Shipments are made within the European Union and to Switzerland, Norway, and Liechtenstein.

The respective customs and tax clearance rules will apply to shipments outside the European Union (currently Switzerland, Norway, and Liechtenstein).

4. Delivery Areas, Delivery Service, and Shipping Costs

4.1 Delivery Areas

We can only accept purchase orders via the online shop www.akris.ch if the goods are to be delivered to Germany, all other EU countries, and Switzerland, Norway, and Liechtenstein. For purchase inquiries outside these countries, please contact one of our boutiques.

4.2 Delivery Service

We ship within ten working days. Should the ordered goods be unavailable, we will inform you as soon as possible. Partial shipments are expressly permitted. No freight will be charged for supplemental shipments.

Deliveries are handled by FedEx or UPS, which require a signature to confirm the receipt. Therefore, goods cannot be delivered to PO boxes.

4.3 Shipping Costs

All purchases from www.akris.ch are dispatched through our partners FedEx (outside Germany) and UPS (in Germany). For the delivery, we charge shipping costs of EUR 30.00 per purchase order. No further shipping costs are charged for supplemental deliveries.

We will send you a confirmation of dispatch (e-mail, mail) as soon as the shipment has been handed over to the shipping partner. In this way, you can track the status of your shipment at www.fedex.com or www.ups.com.

5. Warranty

Unless expressly agreed otherwise, the statutory warranty regulations pursuant to Sections 434 ff of the German Civil Code (BGB) shall apply.

A guarantee of the delivered goods shall only exist if expressly stated for the respective item in the order confirmation.

6 Payment Terms

The goods are payable by credit card (Visa, MasterCard, American Express, Diners Club).

The goods remain our property until full payment is made.

INFORMATION ON THE RETURNS POLICY

Right of Return

You may return the received goods within 14 days by sending them back, without specifying reasons. This period begins upon receipt of this information in writing (e.g. by mail, fax, e-mail), but not before the recipient receives the goods (in the case of recurring delivery of similar goods: not before the first partial shipment is received) and not before the fulfilment of our information obligations pursuant to Section 246 (2) in conjunction with Section 1 (1) and (2) of the Introductory Act to the German Civil Code (EGBGB) and our obligations pursuant to Section 312g (1) sentence 1 of the German Civil Code (BGB) in conjunction with Section 246 (3) of the Introductory Act to the German Civil Code (EGBGB). Only in the case of goods that cannot be sent by parcel (e.g. bulky goods), you can also declare the return in writing in the form of a request for the goods to be taken back. To comply with the period, the due dispatch of the goods or of the request for the goods to be taken back is sufficient. The goods to be returned or the request for the goods to be taken back shall be sent to:

Consequences of Returns

In the event of an effective return, the performance received by both parties shall be returned along with any benefits obtained. In the event of deterioration of the goods and for benefits (e.g. usage benefits) that cannot or not fully be returned or only in a deteriorated condition, you shall compensate us accordingly. You only need to pay compensation for the deterioration of the goods and for benefits gained to the extent that the benefits or the deterioration were caused through handling of the goods beyond the inspection of the properties and functions. "Inspection of the properties and functions" refers to the testing and trying out of the goods in a way that would have been possible and customary in a retail shop. Refund obligations must be fulfilled within 30 days. For you, this period begins with the dispatch of the goods or of the request for the goods taken back; for us, it begins upon receipt.

9. Applicable Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, under exclusion the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of your country of habitual residence remain unaffected.

The courts of Frankfurt/Main, the location of our company's registered office, shall have jurisdiction over all disputes.

Should individual provisions be legally invalid, the other parts of the contract shall nevertheless remain binding.

Akris guarantees the authenticity of all items purchased from the Akris online boutique. All Akris items are designed in the Akris workshops in St. Gallen, Switzerland, and manufactured with high standards in company-owned, directly-managed production plants. Alteration

Top

As we greatly value our customers, we offer premium customer service. All Akris and Akris punto items purchased from our online boutique can be submitted to any Akris boutique in Europe or in the USA (accompanied by the purchase receipt) for alteration. Our professional alteration teams will be pleased to fulfil your alteration requests. Items purchased at the full price are eligible for free alteration. Reduced items can be altered against payment of a fee.

Return

Top

We hope that you are satisfied with all our goods. In the event that you are not satisfied with the goods you ordered, the right of return as applicable to consumers shall apply.

Refunds will only be made to the credit card used for the purchase. For the product price to be credited, please complete the return form and enclose it with the return shipment.

As a special service, Akris offers its customers the option of returning ordered goods to any Akris boutique in Europe or in the USA.

Akris does not accept any liability for refunds or compensation if the return shipment is lost, stolen, or treated improperly. If the products have been worn, washed, damaged, or if the labels have been removed, the compensation obligation may amount to up to 100 percent of the purchase price. Akris reserves the right to refuse to take back goods if the said conditions for returns are not met.
